High Court Slaps Injunction On UDS SRC/NUGS Elections

The Tamale High Court of Justice has placed an injunction on the UDS Tamale Campus SRC/NUGS Elections which was scheduled to come off yesterday, the 25th of March, 2019.
This injunction was granted in pursuance of a motion filed by one Ms. Salifu Alhassan Amamata, a disqualified Women’s Commissioner Aspirant. Ms. Salifu Alhassan Amamata sued the Electoral Commission challenging her disqualification. Ms. Salifu Alhassan Amamata was disqualified on grounds described by the vetting committee as “falsification of documents”.
Order of Interim Injunction
Her vetting took place on the 1st of March, 2019. She had 62.3% of the marks(pass mark is 40%). The aggrieved student was however not happy with the decision of the vetting committee and therefore resorted to the Judiciary Board for closure.
The plaintiff, Ms. Salifu Alhassan Amamata sought the Judiciary Board to reinstate her candidature. The counsel for the plaintiff among many as points argued that her disqualification was based on a “crime” for which its punishment has not been documented in the SRC constitution and therefore is in contravention to the 1992 constitution of Ghana. And that her disqualification was unconstitutional.
The Plaintiff
The Judiciary Board of UDS SRC after hearing the case for two sittings ruled in her favor. The Electoral Commission not happy with the JB’s verdict referred the case to the Appeals Board – this board is chaired by the Dean of students. At the end of their sittings, a decision was taken that Ms. Salifu Alhassan Amamata be revetted. The injunction became effective on Friday, the 22nd of March, 2019. All activities of the Electoral Commission have been put on hold until finality is brought to the case.
Information available to Ayubadailyonline suggests that the Electoral Commission is seeking out of court settlement.
